1. Penerimaan Terma

Terma & Syarat ini mengawal penggunaan sistem kehadiran pelajar iHadir, termasuk laman web dan aplikasi mudah alih ("Sistem"), yang dimiliki dan dikendalikan oleh MyFon Networks Sdn. Bhd. ("MyFon", "kami"). Dengan mendaftar, log masuk atau menggunakan Sistem, anda bersetuju untuk terikat dengan Terma ini dan Dasar Privasi kami. Jika anda tidak bersetuju, sila jangan gunakan Sistem.

2. Perkhidmatan

iHadir menyediakan kemudahan merekod kehadiran pelajar, notifikasi kepada ibu bapa / penjaga, pengurusan kad pelajar, rekod keluar-masuk, pengumuman dan laporan untuk pihak sekolah. Ciri-ciri tertentu mungkin memerlukan langganan atau kredit yang dibayar oleh sekolah atau pengguna.

3. Kelayakan & Akaun

• Pengguna mestilah berumur 18 tahun ke atas, atau menggunakan Sistem dengan kebenaran dan pengawasan ibu bapa / penjaga atau pihak sekolah.
• Anda hendaklah memberikan maklumat yang benar, tepat dan terkini semasa pendaftaran.
• Anda bertanggungjawab menjaga kerahsiaan nama pengguna dan kata laluan, serta semua aktiviti di bawah akaun anda. Sila maklumkan kami dengan segera jika berlaku penggunaan tanpa kebenaran.

4. Penggunaan Yang Dilarang

Anda tidak dibenarkan:

• Mengakses akaun, data pelajar atau maklumat pengguna lain tanpa kebenaran.
• Memalsukan rekod kehadiran atau menggunakan kad / kod QR milik orang lain.
• Memuat naik kandungan yang menyalahi undang-undang, lucah, berunsur fitnah atau menyinggung perasaan.
• Menyebarkan virus, perisian hasad, atau cuba mengganggu, menggodam atau membebankan Sistem.
• Mengumpul atau mengekstrak data daripada Sistem secara automatik (scraping).
• Menggunakan Sistem untuk tujuan komersial atau menghantar mesej spam tanpa persetujuan bertulis kami.

5. Tanggungjawab Sekolah

Pihak sekolah bertanggungjawab ke atas ketepatan data pelajar yang dimasukkan, pengurusan akaun guru dan pentadbir, serta memastikan ia mempunyai asas yang sah untuk memproses data pelajar dan ibu bapa melalui Sistem.

6. Harta Intelek

Semua kandungan, reka bentuk, logo, perisian dan tanda dagangan dalam Sistem adalah milik MyFon atau pemberi lesennya. Anda tidak boleh menyalin, mengubah suai, mengedar atau menjual mana-mana bahagian Sistem tanpa kebenaran bertulis daripada kami.

7. Ketersediaan Perkhidmatan

Kami berusaha memastikan Sistem sentiasa tersedia, namun Sistem disediakan secara "sebagaimana ada" dan "sebagaimana tersedia". Gangguan mungkin berlaku akibat penyelenggaraan, kerosakan teknikal, masalah rangkaian atau perkara di luar kawalan kami. Notifikasi bergantung kepada perkhidmatan pihak ketiga dan tidak dijamin sampai pada setiap masa.

8. Had Liabiliti

Setakat yang dibenarkan oleh undang-undang, MyFon tidak akan bertanggungjawab ke atas sebarang kerugian atau kerosakan tidak langsung, sampingan atau berbangkit yang timbul daripada penggunaan atau ketidakupayaan menggunakan Sistem, termasuk kelewatan notifikasi atau rekod kehadiran yang tidak tepat akibat kesilapan pengguna atau peranti. Rekod iHadir adalah alat bantuan dan tidak menggantikan pengawasan pelajar oleh pihak sekolah dan ibu bapa.

9. Indemniti

Anda bersetuju untuk menanggung rugi dan melindungi MyFon, pegawai dan pekerjanya daripada sebarang tuntutan, kerugian atau perbelanjaan yang timbul akibat pelanggaran Terma ini atau penyalahgunaan Sistem oleh anda.

10. Penggantungan & Penamatan

Kami berhak menggantung atau menamatkan akses anda kepada Sistem tanpa notis sekiranya anda melanggar Terma ini, atau atas permintaan pihak sekolah.

11. Notis Elektronik

Dengan menggunakan Sistem, anda bersetuju menerima notifikasi, e-mel dan mesej berkaitan kehadiran dan perkhidmatan. Anda boleh menguruskan notifikasi melalui tetapan peranti atau aplikasi.

12. Pautan Pihak Ketiga

Sistem mungkin mengandungi pautan ke laman web pihak ketiga. Kami tidak bertanggungjawab ke atas kandungan atau amalan privasi laman tersebut.

13. Pindaan Terma

Kami boleh meminda Terma ini dari semasa ke semasa. Versi terkini akan dipaparkan di halaman ini, dan penggunaan berterusan Sistem bermakna anda menerima pindaan tersebut.

14. Undang-Undang Yang Mentadbir

Terma ini ditadbir oleh undang-undang Malaysia, dan sebarang pertikaian tertakluk kepada bidang kuasa eksklusif mahkamah Malaysia.

1. Acceptance of Terms

These Terms & Conditions govern the use of the iHadir student attendance system, including its website and mobile application (the "System"), owned and operated by MyFon Networks Sdn. Bhd. ("MyFon", "we", "us"). By registering, logging in or using the System, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the System.

2. The Service

iHadir provides student attendance recording, notifications to parents / guardians, student card management, outing records, announcements and reports for schools. Certain features may require a subscription or credits paid by the school or user.

3. Eligibility & Accounts

• Users must be 18 years or older, or use the System with the permission and supervision of a parent / guardian or the school.
• You must provide true, accurate and current information when registering.
• You are responsible for keeping your username and password confidential and for all activity under your account. Notify us immediately of any unauthorised use.

4. Prohibited Use

You must not:

• Access other users' accounts, student data or information without authorisation.
• Falsify attendance records or use another person's card / QR code.
• Upload content that is unlawful, obscene, defamatory or offensive.
• Distribute viruses or malware, or attempt to disrupt, hack or overload the System.
• Automatically collect or extract data from the System (scraping).
• Use the System for commercial purposes or to send spam without our written consent.

5. School Responsibilities

Schools are responsible for the accuracy of student data they enter, managing teacher and administrator accounts, and ensuring they have a lawful basis to process student and parent data through the System.

6. Intellectual Property

All content, designs, logos, software and trademarks in the System are owned by MyFon or its licensors. You may not copy, modify, distribute or sell any part of the System without our written permission.

7. Service Availability

We strive to keep the System available, but it is provided "as is" and "as available". Interruptions may occur due to maintenance, technical faults, network issues or matters beyond our control. Notifications rely on third-party services and are not guaranteed to be delivered at all times.

8. Limitation of Liability

To the extent permitted by law, MyFon shall not be liable for any indirect, incidental or consequential loss or damage arising from the use of, or inability to use, the System, including delayed notifications or inaccurate attendance records caused by user or device error. iHadir records are an aid and do not replace supervision of students by the school and parents.

9. Indemnity

You agree to indemnify and hold harmless MyFon, its officers and employees from any claims, losses or expenses arising from your breach of these Terms or misuse of the System.

10. Suspension & Termination

We may suspend or terminate your access to the System without notice if you breach these Terms, or at the request of the school.

11. Electronic Notices

By using the System, you agree to receive notifications, emails and messages relating to attendance and the service. You can manage notifications via your device or app settings.

12. Third-Party Links

The System may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

13. Changes to Terms

We may amend these Terms from time to time. The latest version will be displayed on this page, and continued use of the System means you accept the amendments.

14. Governing Law

These Terms are governed by the laws of Malaysia, and any dispute is subject to the exclusive jurisdiction of the Malaysian courts.
